The ASHA Board of Ethics has found the following audiologist and speech-language pathologists in violation of the association’s Code of Ethics. The information below includes the version of the code violated, the rationale, and the sanction with its effective date.
Audiologist
Michael R. Trythall
Los Angeles, California
  • Rationale: Received three convictions in the Northern District of California for felony tax evasion in the amount of $232,254; embezzlement of $756,577 from his employer; and falsifying tax returns, resulting in imprisonment of two years in federal prison.

  • Code (2010r): IV, IV-A, IV-C, IV-E

  • Sanction: Withholding of membership and certification for five years, effective May 2, 2018.

Speech-language pathologists
Jennifer N. Austin
Costa Mesa, California
  • Rationale: Received disciplinary action in 2014 by the California Speech-Language Pathology and Audiology and Hearing Aid Dispensers Board secondary to convictions in New Jersey related to fraud and substance abuse; and failed to respond to the Board of Ethics complaint against her.

  • Code (2016): I, I-R, IV, IV-D, IV-E, IV-P, IV-R, IV-T

  • Sanction: Withholding of membership and certification for 10 years, effective May 2, 2018.

Silvia A. Graves
Simpsonville, Georgia
  • Rationale: Admitted to improper or fraudulent billing for services not provided in a Consent Agreement with the South Carolina Board of Examiners in Speech-Language Pathology and Audiology, resulting in a public reprimand and stayed suspension with probation of one year.

  • Rationale: Found guilty by a jury in 2017 of four felonies in the 370th District Court of Hidalgo County, Texas, including capital murder; theft of property of $200,000 or more; theft of more than $100,000 but less than $200,000; and misapplication of property as a fiduciary.

  • Rationale: Improperly billed a third-party payer for experimental services, requiring her to reimburse more than $27,000; used experimental techniques without informing clients of their experimental nature; failed to appropriately document and authenticate services provided; marketed and advertised non-evidenced-based products and services on her website; and failed to respond to the Board of Ethics complaint against her.
